Health Licensing
Licensing
Certain businesses are required to be licensed under the Health Act 1956 and Regulations made thereunder, The Health (Registration of Premises) Regulations 1966, Local Government Act 2002 and the Hurunui District Council ByLaws.
Certificates of registration/permits/licences expire on the 30th of June each year.
Food Premises, Hairdressers, Offensive Trade, Camping Grounds
Premises are registered and inspected annually. At the beginning of June each year, businesses that have a current licence with Council will be forwarded a renewal form.
Process
Existing Businesses
• If the business is existing Council will have a record of the annual inspections and any requisitions outstanding. If you buy a business, that has outstanding requisitions, you will be liable for the cost of putting things right. It is recommended that prospective owners or their lawyers apply to the Council, prior to the sale, for a list of any outstanding requisitions.
It is suggested that those selling a business should request a pre-sale assessment by the Environmental Health Officer to determine that any outstanding requisitions have been addressed. The Council charges this work on a time charge basis.
• If a business is sold, the new occupier must apply for a transfer of registration within 14 days. No fee is charged for the change of details on the Certificate of Registration.
• A deposit of $100 is required to be accompanied with this transfer of licence form if an inspection by the Environmental Health officer is requested. The Council charges this work on a time charge basis and this cost will be offset against the deposit charge.
New Businesses
• Prospective owners should contact the Environmental Health Officer to discuss their proposal. The Environmental Health Officer is required to sign off your premise before opening and discussions early in the planning process can be of benefit to you.
• Complete application form and forward with appropriate fee to Council
• On authority from the Environmental Health Officer the Administration Officer will forward the Certificate of Registration.
Stands and Stalls, Mobile/Travelling Shops, Itinerant Traders and Hawkers
In 2008 Council adopted the Public Places ByLaw, which requires that all stands and stalls, mobile/travelling shops, itinerant traders and hawkers are licensed.
Please note the restricted areas, maps and conditions for Mobile or Travelling Shops in the ByLaw.
Process
• Operators should contact the Administration Officer to discuss the area in which they wish to operate. It is also recommended that you contact the Environmental Health Officer who is required to sign off your business before you can sell in the area. Discussions early in the planning process can be of benefit to you.
• Complete application form (included in ByLaw) and forward with appropriate fee to Council, include completed Request to Stand on Council Reserve form if required.
• On authority the Administration Officer will forward the Certificate of Registration.
