Giving effect to the Proposed District Plan
The Council has received six appeals on the Decisions Version of the Proposed Plan. The chapters directly affected are 3, 4, 5, 7, 11, 12, 13, 15, 17 and 20. In accordance with Section 86F of the Resource Management Act, any rules not affected by an appeal are treated as operative (and any previous rules in the 2003 Operative Plan are inoperative). Note however, that rules may be affected by an appeal even if not directly appealed. Therefore, while identification of the provisions under appeal can provide general guidance as to which rules will or will not be treated as operative by the Council, it is not definitive.
The appeals are currently at the mediation stage.
Appeals update - updated 17 August 2017
Two appeals have been resolved through mediation, this being the appeals by Transpower and Meridian. The Environment Court has issued decisions and Consent Orders on these appeals. The decision stated that the appeal is allowed to the extent that Hurunui District Council is directed to make amendments to the Proposed Hurunui District Plan. These amendments have been incorporated into the Decisions Version of the Proposed Hurunui District Plan.

Clause 16 amendments - updated 18 August 2017
Clause 16, Schedule 1 of the Resource Management Act 1991 allows the Council to make amendments to the Plan where the alteration is of minor effect or correcting a minor error.

The Proposed Hurunui District Plan as Amended by Decisions on Submissions (October 2016) was publicly notified on 15 October 2016. This is the result of the Council adopting the District Plan Hearing Committee's Decisions on Submissions 2016.
